Obama cannabis reversal

THE Obama White House will not seek to arrest medical cannabis users and dealers as long as they conform to state laws.

The decision is a significant departure from policy in the Bush White House.

The previous administration had insisted it would continue to enforce federal anti-cannabis laws regardless of state legislation.

But under policy guidelines sent to federal prosecutors, on Monday, two Justice Department officials said prosecutors would be told it was not a good use of their time to arrest people who used or provided medical cannabis in compliance with state laws.

Fourteen states allow some use of the drug for medical purposes. They are Alaska, California, Colorado, Hawaii, Maine, Maryland, Michigan, Montana, Nevada, New Mexico, Oregon, Rhode Island, Vermont and Washington.

California is unique with its widespread presence of chemists who sell cannabis and even advertise their services. Colorado has several dispensaries, and Rhode Island and New Mexico are about to license providers.

Attorney-General Eric Holder said in March that he wanted federal officials to pursue those who violated both federal and state law, but it has not been clear how that goal would be put into practice.

A memo was sent to federal prosecutors in the 14 states, and also to leading officials at the FBI and the Drug Enforcement Administration.

Officials said the memo emphasised that prosecutors had wide discretion in choosing cases to pursue, and said it was not a good use of federal manpower to prosecute those who were, without a doubt, in compliance with state law.

The news won praise from Ethan Nadelmann, executive director of the New York Drug Policy Alliance, which says it promotes alternatives to the ''war on drugs''.

''These new guidelines effectively open the door to sensible collaboration between state governments and medical marijuana providers in ensuring that patients have safe and reliable access to their medicine,'' he said in a statement.
